Abstract

The verdict coram Stankiewicz of 27th february 2004 is a full stop about exclusion of dignity sacrament’s of the marriage, not only because outlines with clarity the correct diagram of interpretation, but also because this result is the fruit of a meticolous and attentive work as much at the teaching of the Pope and the theological thought as at traditional and recent pertinent jurisprudence, of which are armonized the positions with the worries expressed by John Paul 2nd in the Speeches in the years 2001 and 2003, in which is very important the natural reality of the marriage, that is in itself sacrament, not be connected with the faith of the newlyweds. The judge by expert jurist faces the theme of the exclusion of dignity sacrament’s of the marriage, which can be in the matrimonial trial, both if the dignity sacrament’s of the marriage has exclused by a positiv absolute and prevailing act of the will, so to concern also matrimonium ipsum, and by simple act of the will.
