Abstract

The forced retirement of the civil party from a criminal trial in which plea bargaining has been used to accelerate proceedings, leads to the defendant being required to pay the costs incurred for the constitution of the civil party, except for compensatory effect (Article 444, paragraph 2, of the Criminal Procedure Code). The failure to provide conclusions in written form in the ordinary trial does not represent tacit, or presumed revocation of the constitution of the civil party, provided that the conclusions have been supplied by the civil party in the course of the previous hearing, in deference to the principle of immanence.
