Environmental Protection and Markets in Waste Management. The Transposition of Directive 2008/98/EC into Italian Legal System

Abstract

This work represents an approach to the complex relationship between regulations on waste and market. In fact, environmental regulations were created on a community level around the mid 1970's, above all to prevent different regulations and standards between member States from creating a distortive effect for the competition. In Italy, with legislative decree no. 205 dated 10 December 2010, the framework Directive on waste 2008/98/EC – where the legislator finally had decided to change course and consider the market a sort of ally - was transposed into the internal code. The main objective of the new legislative decree – even if it takes excessive referral to future regulations for actuating part of the legislation - concerns the recomposition of the relationship between market and environment, which implies acceptance by the entrepreneurs, of the limitations and rules imposed by the environmental laws, compensated by easier and simplified laws compared to the past.
