Abstract

The success observed in the practical experience of probation for youth offenders pushed the legislator to introduce the probation rules in the ordinary system, in several occasions. In the last, a recent government bill (d.d.l. 29 february 2012, n. 5019) did not fully welcome the principle of restorative justice, as indicated in the European rules of probation, but mostly preserved the model of retributive justice.
