Access to Environmental Information in the Eu and in Italy: towards a Good Administration

Abstract

The right to Good Administration has assumed an extremely important role in Europe. The aim of this article is to demonstrate the configurability of administrative information as an important and democratic tool, to finally achieve a new concept of Good Administration. Indeed, this principle cannot be mere compliance with the rules, but the action of Public Administration must be based on loyalty and spirit of collaboration. In this renewed perspective, the role reserved for the right of access assumes central importance. In Italy however seems that access is considered as an exception just like for the environment, even if with the introduction of F.O.I.A. in 2016 citizens were given the right to request access to public data and documents, without having to justify their request. This seems the main instrument which Administrations have to allow the citizens to verify the effective respect of the principle of Good Administration.
