The Territorial Scope of Application of the EC–Israel Association Agreement in the Light of the Brita GmbH Case.

Abstract

In the Brita GmbH v. Hauptzollamt Hamburg–Hafen Case, the European Court of Justice delivered an important judgment on the trade implications of the status of the territories occupied by Israel and, in doing so, it gave its opinion on which economic borders of that State have to be considered as «legitimate and recognized». The Court has thus intervened on a very complex issue of international relations, such as that of the borders dispute between Israel and the Palestinian territories. This judgment is very interesting because it is an example of the potential interaction between public international law and eu law and of the emerging EU’s pursuit to find its own constitutional identity through the exercise of the judiciary power by the European Court of Justice.
