UN Territorial Administrations: Between International Humanitarian Law and Human Rights Law

Abstract

The paper deals with the legal phenomenon of international territorial administration, which occurs when an international organization performs governmental functions in a territory. The main examples of international territorial administrations were offered by UNTAES in Eastern Slavonia, UNMIK in Kosovo and UNTAET in East Timor, created by the United Nations Security Council in the late ‘90s, but there are some relevant examples also in the previous practice of the League of Nations, of the United Nations and of the European Union. The author considers the application of the rules of International humanitarian law and of human rights protection in the context of the international territorial administration, evaluating the legal docrtine on this topic and the relevant international practice. At last, the author analyses the strengths and limits of the judicial and non-judicial mechanisms of control over the activities of the international territorial administrations established at international as well as at national level.
