L'evoluzione dei modelli familiari: dal principio di autorità alla tutela delle libertà personali
Abstract
In the category of social formations, since ancient times, the family has taken on the appearance of organic and peculiar social group, having the primary function of meeting the needs of its members and their sustenance and protection. By virtue of the social changes, the traditional configuration of the apical family, founded on the principle of authority, over time, have been joined by other models of aggregate family, inspired by the principle of freedom. In the vision of the family, therefore, under the thrust of times, has changed the structure of power, which, from a monocracy power, became diarchy power, even when not pluralistic. In this passage was decisive the role Constitutional Court, which has attempted to adapt the rules of the Civil Code and the rules related to the principles and values of the Constitution. In the diachronic sources and in the evolution of social reality, the family, from the closed society and authoritarian, characterized by the position of mere subjection of the woman to her husband, has increasingly assumed the character of an open community, in which the personality of the individual matures in a natural way, sometimes supported, but never oppressed by the state. The connotation has strengthened the primary function of the family as a place of suffering, feelings and solidarity.
