Abstract

The Constitution don’t rise only like State’s foundactive act, but it must say that the State is Constitution too. Therefore the secularization of the welfare State brings to the depletion of the same political outside and above of the constitutional legal order. This fact has determined an irreparabile fracture between society and politics. The constitutional antinomies, here criticized, leads at the fact that only through a new politics’s constitutionalization could be true a new legal order, brooken by political parties’s conveniences, always by now evident. The social conflict don’t rise by the simmetric roles in opposition between themselves, but by a State anymore Constitution rather only a politics.
