Abstract

The article will discuss the primary linguistic theories in order to examine criminal proceedings. The accusatorial system, in fact, could be interpreted through alternative analysis to usual exegetical methods (i.e. case law and legal doctrine). The original use of philosophy of linguistics dates back to J. L. Austin's development of performative utterances and his theory of locutionary, illocutionary, and perlocutionary acts. Judgements, evidences, and decisions are taken to include such acts as promising, ordering, greeting, warning and inviting. This study will present multiple legal issues with respect to metalinguistic perspective of the accusatorial system.
