Abstract

Adr and the right of access to justice: the difficult connection between the European model and Italian model of compulsory media - conciliation. In Italy the debate on adr took full account of the evolution of European Union legislation on the same matter. The Author reconstructs the overall framework of EU law in the field of ADR and analyzes the relationship between those rules and some European Union instruments on judicial cooperation in civil matters. The Author also compares the European model and the Italian model indicating many contradictions between the two models.
