Abstract

The A. explores the theories on the legal drafting, investigating the reasons of its development as a subject regulated by legal system inside and in European Law. The focus is on the different way the legislator defines the formal structure and the substantial content of legal texts with respect to the model of Civil Code. Concerning the civil law, the aim is to improve the quality of the political determinations on the market and, particularly, to control the impact of regulation on society and on development of the market itself. In the final reflections, the A. underlines the fundamental role of Constitution in the inside legal system and refers to debate in ‘Assemblea Costituente’ as a model of political debate that could produce a fair «battle for juridical signification».
