Sovraffollamento di una capitale nella Novella 80 di Giustiniano
Abstract
Between 535 and 539 Justinian tried to improve the control of the public order in Constantinople whose huge population continued to increase because of immigration from the various provinces of the empire. Novel 13 created the praetor plebis who integrated the urban prefect in order to prosecute crimes and stop riots. Novel 80 testifies the successful experience of the praetor plebis and, at the same time, highlights the necessity of a third urban officer with the specific role of expelling those people coming from the provinces, who did not have a cogent reason to stay in the city. The quaesitor was therefore appointed with the function to fasten the trials involving people who were not resident, especially peasants whose absence from the field caused serious damage to agriculture and to the whole economy of the empire.
