Recent Developments in Italian Competition Law: an Introduction (2009 and 2010)

Abstract

These notes provide some introductory notes to the detailed reviews of the main developments in public enforcement of antitrust rules (both EC rules and the Italian competition law — Law no. 287 of 10 October 1990) occurred in 2009 and 2010. What emerges is an increasing massive use of commitments, compared to other remedies, and a regressive application of interim measures in agreement and abuse cases. As for mergers, despite the exiguous number of phase two decisions, new guidelines have been set with regard to the very notion of merger and to the modification of commitments following changes in the economic conditions existing at the times they were undertaken. The overview also includes some preliminary remarks on the Italian competition authority’s (the Autorità Garante della concorrenza e del mercato, hereafter: Agcm) advisory powers with regard to the in house provision of local public services (as set forth by art. 23-bis of Law no. 133 of 6 August 2008).
