Abstract

The pre – trial investigation is a phase of the criminal law proceedings,during which the human rights protection of the investigated persons is weakened on the behalf of the public interest to conduct a criminal investigation. The principle of equality of arms couldn’t be fully applicable in the pre – trial phase, as the human rights protection of those under investigation is affected by the scope and the function of the investigations.
